General
We reserve the right to refuse to construct or host a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
JamJar Media takes no responsibility for any information loaded to our customers accounts or servers – nor do we have a policy of policing clients’ web content but if something is brought to our attention which contravenes the above, we reserve the right to remove the offending material and terminate our contract with the offending party without recompense.
JamJar Media does not permit certain types of content to be hosted on our servers. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the author and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator or copyright owner of the work.
The use of our servers to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.The use of web cam applications that maintain a constant FTP connection uploading an image at regular intervals is forbidden.
We reserve the right to terminate any accounts, at any time, where the user has made inappropriate or unreasonable use of any of JamJar Media services.
Inappropriate or unreasonable includes, but is not limited to, materials whose nature and/or volume compromises the ability of JamJar Media servers to serve other users’ web presence, unreasonable consumption of disk space, internet link bandwidth, CPU, and memory usage, also that which is mentioned above.
Hosting
Renewal of hosting is due on a yearly basis. The date of renewal will be annually from the date the website was ordered by the client. The hosting will not be renewed if JamJar Media cannot contact the Client or the Client requests for JamJar Media to not host this site. This will also affect the domain.
The Hosting renewal charge must be received within 10 days of the Hosting expiry date. JamJar Media reserve the right to deactivate any website where the hosting has expired and the client has not paid the renewal charge. There will be an admin fee set by JamJar Media for reactivating the website/hosting.
If the client does not use JamJar Media hosting services, then the management and hosting of the domain name are the full responsibility of the client.
Should a client wish to move hosting away from JamJar Media or transfer a domain name away from JamJar Media, a £40 admin charge will be issued, which must be paid before the transfer takes place.
JamJar Media is not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss due to interruption of service.
Domain
If a domain name is purchased by the client through a company other than JamJar Media, the client has full responsibility in making sure that the domain name is renewed when due. If a domain name expires, JamJar Media will not be held liable for this.
JamJar Media will not renew the domain name when annual Hosting renewal is due if the domain name is purchased through a company other than JamJar Media.
Services
JamJar Media will provide the client with an expected completion date for the project if requested. JamJar Media will endeavour to meet any given deadline, but do not guarantee and are not bound in any way to complete the project by this date. The expected completion date provided by JamJar Media is purely an estimate.
The client shall not be charged for the use of open source software. Open source software is not owned by JamJar Media or the client.
All materials text, images, sound and video supplied by the client and used in the construction of the client’s web site, will remain the client’s property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.

All such material will be assumed to be the property of the client or the client unconditionally guarantees that they have written permission to use them from the rightful owner and indemnify JamJar Media from any claim or suit arising from the use of such items supplied by the client.
Where images have been purchased by JamJar Media on behalf of the client, these images are strictly for use on the website only. JamJar Media are not liable for misuse of these images by the client or any other person’s copying, altering or distributing the images to individuals or other organisations.
JamJar Media has no control of, or responsibility for, the content of clients website. In no way does the textual or image based content of our client’s web sites constitute JamJar Media’s endorsement, or approval. JamJar Media provides links or references to our client’s websites solely for the convenience of prospective customers and intends that the links it provides be current and accurate, but does not guarantee or warrant that such links will point to the intended client site at all
times.JamJar Media are not liable for loss, damage or corruption to files or information stored on its servers or individual PCs relating to a client’s website.
Promotion
JamJar Media makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
JamJar Media will make every reasonable effort to promote the website effectively but do not guarantee high placings in search engine results.
Payment
JamJar Media will only commence work on a project after receipt of a non refundable, 50% deposit of the quoted project fee from the client. JamJar Media will also require 25% payment upon overall approval of the home page design. The final 25% payment is to be made on completion of the website. The website will be switched to “Live Mode” once the clients remaining balance is paid in full.
The deposit paid to JamJar Media covers the cost of design work carried out as well as any admin work and communication with JamJar Media. The deposit is non refundable.
JamJar Media expects payment by Paypal (5%) or cheque within 7 days of the date on the invoice. If paying by cheque, any pending work will be commenced only after the cheque has cleared into our bank account.
JamJar Media reserves the right to alter prices at any time without notice. If a client has commissioned any services from JamJar Media prior to a change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.
Cancellation
If the agreement is cancelled after work has commenced, the client will be liable for any costs for purchases or labour made on the clients behalf incurred up to and including the date of cancellation.
Termination
JamJar Media reserves the right to terminate service at any time. Any violation of policies will not receive a refund if we institute our right of termination. Any violation which results in extra costs will be billed to the customer.
